The definition
A hidden defect is a flaw that makes the building unfit for its intended use, or that reduces its usefulness so much that the buyer would not have bought it, or would have paid less, had they known. To be recognized as such, a defect generally has to meet four conditions:
- Hidden: it was not apparent and a prudent buyer could not detect it through a normal examination
- Serious: it seriously affects the use or value of the property
- Pre-existing: it existed before the purchase
- Unknown to the buyer: you did not know about it when you bought
